Safety, Emergency Response and Environmental Management
This is an important section of the conditional agreement as it responds to many of the concerns raised by community members and by leadership in the past. It aims to:

Make sure there is a clear and open relationship between LNIB and Kinder Morgan.

Create the measures needed to ensure safety and environmental best practice.

Ensure our community is compensated if there is a spill.
The Gist

Kinder Morgan would be committed to causing minimum impact to LNIB territory during construction.

If an emergency happened, LNIB would be involved in creating and carrying out the action plan.

If there were a risk to the health or safety of LNIB members, Kinder Morgan would reimburse LNIB for the reasonable costs of providing for the health and safety of LNIB members affected by the incident.
Projects
General

Concerns would be raised through the implementation committee.

Kinder Morgan would be committed to following best practices as well as appropriate laws.

Kinder Morgan would be committed to providing as much notice as possible (30 days where possible) for any excavation work carried out to inspect, repair or maintain the Trans Mountain Pipeline System.
Emergency Response

Kinder Morgan would be committed to consulting with LNIB when developing its emergency response plan.

Kinder Morgan and LNIB would meet at least once per year to review the emergency response plan and emergency management program.
Spill Reporting and Response

Kinder Morgan would have to report any spills to LNIB immediately and then provide regular updates.

Any remediation work would have to follow applicable laws, the emergency response plan and best practices.

If there were a risk to the health or safety of LNIB members, Kinder Morgan would reimburse LNIB for the reasonable costs of providing for the health and safety of LNIB members affected by the incident.
